Merck to appeal Fosamax patent ruling to US Supreme Court

Merck & Co. announced Thursday that it would file an appeal with the US Supreme Court after a lower court rejected its request to reconsider the patent expiration of its osteoporosis drug, Fosamax, CNN Money and ABC News report.


A US appeals court said it would not reconsider the decision it made in January on Merck's once-weekly Fosamax patent, which stated the patent would expire by February 2008. The suit, which was brought by generic drugmaker, Teva, took 10 years off the drug's original patent expiration date, Merck spokeswoman Janet Skidmore said, CNN Money reports.


Fosamax had $3.2 billion in sales last year.

WASHINGTON (Reuters) - The Supreme Court said Monday that it rejected Merck & Co.'s appeal of a ruling that the patent on its blockbuster, once-weekly osteoporosis drug Fosamax will expire a decade earlier than expected.

The justices declined to review a ruling by the U.S. Court of Appeals for the Federal Circuit that Fosamax's patent would run out by February 2008, a victory for generic drug maker Teva
